The agreement between DOMS and the coaches who use it.

Effective date: September 28, 2026. These terms are an agreement between you, the coach who creates a DOMS account, and DOMS (“we”, “us”). DOMS is operated by its founder from British Columbia, Canada; we will name the registered business here once it is registered. By creating an account or using DOMS you agree to them. Our privacy policy, linked at the bottom of this page, is part of these terms.
1. What DOMS is
DOMS connects to your Instagram professional account and helps you answer direct messages. It prepares replies in your voice from the knowledge, offers, prices, rules and resources you set up; it can share the links you saved, ask the questions you wrote, and hand a conversation to you when it should. New accounts start in approval mode, where every reply waits for your tap. You may switch on automatic replies at any time; the safety rules still apply and you may switch back.
DOMS is offered as a private beta. Features may change, appear or be withdrawn while we improve it.
2. Who may use DOMS
You must be at least 18, able to enter a contract, and using DOMS for a business you run or are authorised to represent. You must hold the Instagram account you connect and have the right to use everything you put into DOMS. Keep your password private; you are responsible for what happens under your account until you tell us it has been compromised.
3. Your responsibilities
- Instagram's rules. You must follow Instagram's and Meta's terms and policies for your account and for messaging. DOMS only replies to people who message you first, never sends a first message to a stranger, and stops at a daily limit, but your account is yours and Meta's decisions about it are outside our control.
- What DOMS says. DOMS only states the prices, terms, links, facts and claims you saved. You are responsible for their accuracy and for any promises they make. Do not save claims you cannot support, such as guaranteed results or medical claims.
- Telling people about automation. DOMS writes in your name. Where the law where you or your audience live requires you to tell people that automated software is replying, you are responsible for doing so; DOMS offers a setting that answers as your assistant, and in either setting it never claims to be a human when asked.
- The people in your inbox. You are the business that collects their information. You must have a lawful basis to use DOMS with them, honour their requests to stop or to have their data deleted (we help, as the privacy policy describes), and not use DOMS to collect health or other sensitive information you do not need. If you tell DOMS who you work with, you are responsible for that rule being lawful where you operate.
- Anti spam law. Follow ups DOMS sends are messages from you. You are responsible for compliance with anti spam laws that apply to you, including Canada's.
- Minors and care. Do not use DOMS to sell to anyone under 18. When DOMS hands you a conversation because someone may be in distress or in crisis, the response is yours; DOMS is not a medical, mental health or emergency service.
4. What you may not do
Do not use DOMS to harass, deceive, discriminate unlawfully, send unsolicited messages, sell anything illegal, or impersonate someone else. Do not try to reach another coach's data, probe or overload the service, resell it, or reverse engineer it. Do not upload content you have no right to use or content that is illegal. We may suspend an account that breaks these rules.
5. Your content and ours
Everything you put into DOMS, and every message you receive through it, remains yours. You give us permission to store, process and display it only to provide the service to you, as described in the privacy policy, and to improve DOMS for your account. Suggestions DOMS makes are yours once you accept them. The DOMS software, design and documentation are ours; you may use them only through the service.
6. Artificial intelligence and its limits
DOMS uses AI models to read and write. They can be wrong: they can misread a message, miss a question, or word something badly. We reduce this with fixed rules (only saved prices and links, no invented facts, a stop for distress, a stop for people under 18, no replies to protected people) and with approval mode, but we do not guarantee any reply is correct, complete or suitable. Read what DOMS writes, especially early on, and use the corrections and Teach controls to fix it. We do not use your data to train our own models; our providers process it under the terms in the privacy policy.
7. Third party services
DOMS depends on Instagram (Meta), our Instagram connection provider (Zernio), AI providers, hosting, email delivery and, if you connect one, a calendar provider. The checkout and booking links you save point at services you chose; those services are yours and outside these terms. Their availability, rules and prices are outside our control. If a provider changes or withdraws access, DOMS may stop working in part or in whole and we will tell you what we know.
8. Fees
During the private beta, DOMS is provided at the price we agree with you in writing, or free of charge if none is agreed. If we introduce or change fees, we will tell you the price and the date it starts at least 30 days before you are charged, and you may close your account before then. Fees are stated in Canadian dollars unless we say otherwise and do not include taxes.
9. Ending the agreement
You may stop using DOMS and ask us to delete your account at any time, by email with the subject “Delete my account”, as the privacy policy describes. We may suspend or end your account if you break these terms, if the law or a provider requires it, or if we stop offering DOMS, with as much notice as we reasonably can give. When the account ends, we delete its data as the privacy policy describes.
10. Disclaimers
DOMS is provided “as is” and “as available” during the beta. To the extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, uninterrupted service or results. Nothing DOMS writes is professional, medical, legal or financial advice to you or to anyone in your inbox.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales, lost data, or actions taken by Instagram or Meta against your account. Our total liability for all claims arising from these terms or the service in any twelve month period is limited to the greater of the fees you paid us in that period and 100 Canadian dollars. Some laws do not allow these limits; where they apply, our liability is limited to the smallest amount those laws allow.
12. Indemnity
If a third party makes a claim against us because of content you saved, messages sent from your account, your breach of these terms or of Instagram's rules, or your handling of the personal information of people in your inbox, you will defend us and pay the resulting damages and reasonable legal costs.
13. Governing law and disputes
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute will be heard in the courts of British Columbia, and you agree to their jurisdiction. Before starting a claim, each of us agrees to try to resolve the matter by writing to the other and talking for 30 days.
14. Changes to these terms
We may change these terms. We will post the new version here with a new effective date and, for changes that matter, tell you by email or in the app at least 14 days before they take effect. Using DOMS after that date means you accept them.
15. General
These terms and the privacy policy are the whole agreement between us about DOMS. If a part is unenforceable, the rest stands. You may not transfer your account; we may transfer this agreement to a successor that takes over DOMS. Our not enforcing a term is not a waiver of it.
